A California housewife is facing a second-degree murder charge after the fetish encounter she was paid for turned fatal. Michaela Brashaye Rylaarsdam was paid over $11,000 by Michael Dale for various bondage, discipline, dominance, submission, sadism, and masochism (BDSM) activities. The 31-year-old mother is an OnlyFans creator and at the time of the incident two years ago, was advertising her services online. 55-year-old Dale reached out to her after seeing her ad with some extreme requests.

Rylaarsdam claims that she was new to fetish work, particularly to the type of extreme BDSM that Dale was interested in. Despite her inexperience, she agreed to wrap him in Saran wrap like a mummy and glue women’s boots to his feet per his request. But it seems things didn’t go quite as planned when she arrived at his home.

The incident took place two years ago, on April 17th, 2023. That evening, Rylaarsdam arrived at Dale’s home to find the man intoxicated, but the two decided to move ahead with their plan. But by 10pm it was clear something had gone wrong. That’s when she called 911. First responders arrived shortly, discovering her performing CPR on Dale.

He was transported to the hospital but declared brain dead and taken off life support within just a few days. According to authorities, his cause of death was suffocation and lack of oxygen to the brain. And that led to Rylaarsdam being charged with second-degree murder. She is currently being held without bail and has pleaded not guilty.

Deputy District Attorney David Jarman is the prosecuting attorney in this case, and explained the reasoning behind the charge: “The evidence showed that he hired her to perform bondage acts and fetish acts. There is no indication that he asked her to obstruct his breathing, asked her to put tape over his mouth, asked her to put a plastic bag over his head.”

And in this case, there is clear evidence. Not just of Dale’s requests, which were very clear in the two’s communication. But of what happened that evening. Because Rylaarsdam recorded much of it to use as content for her OnlyFans account. According to an affidavit, the videos show Dale struggling to breathe with duct tape over his mouth, a plastic bag over his head, and more cling wrap, then duct tape, around his face and head, according to an affidavit. He also was unable to remove any of the coverings himself, as his wrists were bound, his fingers covered in duct tape and his legs were wrapped in plastic.

However, David Cohen, Rylaarsdam’s defense attorney, does not believe that his client is guilty because there was consent in this case. He does concede that consent isn’t necessarily a defence, but that it is potentially a mitigating factor.

“There is definitely a consensual element — not only something he consented to, something he was actively seeking,” Cohen explained. He believes that since his client called 911, gave CPR, and cooperated with police that she clearly did not intend for Dale to die.

It does seem that this is an example of BDSM gone wrong. The video evidence reveals that Dale struggled to breath for at least 8 minutes, which is what led to his ultimate death. It seems that neither of them were familiar with the typical protocols followed by those in the BDSM community. BDSM practitioners typically use Risk-Aware Consensual Kink (RACK) or Safe, Sane, and Consensual (SSC) to ensure both participants stay safe.

When attempting extreme acts like breath play, there should be multiple safety precautions to avoid a tragic result like this one. If Rylaarsdam and Dale had followed any of these precautions, then Dale would likely still be alive and Rylaarsdam wouldn’t be facing a potential future in prison away from her three small children.
